  • DIVORCE
    For the most part, Pennsylvania is a no-fault divorce state. The divorce process can be fairly quick and easy or it can be lengthy and complicated. Much depends on the actions of each spouse. There are several steps in the divorce process: once a divorce complaint is drafted, signed and filed with the county Prothonotary, the completed document is "served" on the other spouse. Once the divorce has been served on the non-suing spouse, there is a 90 day cooling off period during which time no action can be taken regarding the divorce. Once the 90 days have passed, the parties to the divorce are eligible to sign "affidavits of consent." If both parties sign the affidavits, the court will grant a divorce decree, so long as the economic issues of the divorce have been agreed to. However, if one party does not consent to be divorced under the no-fault statute, there is up to a two year waiting period (from the date of separation) before the court will divorce a party. Typically, under a nonconsensual no-fault scenario, once the two years have passed from the date of separation, the court will grant a party a divorce even if the other party refuses to consent.

    In addition to attorney fees associated with a divorce, each county charges a filing fee to process the divorce. In Franklin County, for instance, the fee is $125.50.
